1. Acceptance of Terms

By accessing or using the Masala Munch website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.

2. Service Description & Orders

We offer Indian snack food boxes for sale online. All orders are subject to availability and acceptance. We reserve the right to refuse service to anyone for any reason at any time. Prices for our products are subject to change without notice.

3. Shipping and Delivery

  • Courier Service: We utilise third-party couriers (e.g., Aramex) for delivery.
  • Delivery Restrictions: As we use courier services, we cannot deliver to PO Boxes or Parcel Lockers. Customers must provide a valid physical street address.
  • Failed Deliveries: If an invalid address is provided, the order may be returned to us. Any re-shipping costs will be the responsibility of the customer.
  • Delivery Times: Estimated delivery times provided at checkout are estimates only and not guaranteed.

4. Payment Terms

All prices are listed in Australian Dollars (AUD). We accept payments via Credit Card, PayPal & Shop Pay. By submitting your payment information, you authorise us to charge the specified amount to your chosen payment method.

5. Returns and Refunds

  • Change of Mind: We do not offer refunds for "change of mind" purchases.
  • Australian Consumer Law (ACL): Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
  • Damaged Items: If your product arrives damaged or faulty, please contact us at crunch@masalamunch.com.au within 48 hours of delivery with photos of the damage so we can investigate.

All content on this website including text, graphics, logos, images, and product recipes are the property of Masala Munch and is protected by Australian and international copyright laws. You may not reproduce or distribute any content without our express written permission.

7. Liability & Disclaimers

  • Food Safety: Our products are prepared by third-party manufacturers in facilities that may handle common allergens, including nuts, dairy, and gluten. While our manufacturers take precautions, we cannot guarantee the complete absence of cross-contamination. Customers with severe allergies should exercise caution.
  • Limitation of Liability: To the maximum extent permitted by law, Masala Munch is not liable for any indirect, incidental, or consequential damages arising from the use of our website or the consumption of our products. This does not exclude any consumer guarantees provided under the Australian Consumer Law.

9. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in New South Wales.
